Constitutional Convention Fails In New York, Pension Forfeiture Passes The New York State Constitution will remain the same...at least for the next 20 years. New Yorkers overwhelmingly opposed calling a Constitutional Convention, 78 percent to 16 percent. The ballot measure was opposed by labor groups, politicians and numerous organizations on both the left and the right. A constitutional convention will again be on the ballot in 2037. In Westchester, the ballot measure failed 75 percent to 18 percent. In Putnam, it failed 86 percent to 12 percent, while Dutchess voters said no 82 percent to 14 percent.
